TUWA TERMS & CONDITIONS (T&C)

This Terms & Conditions (“Agreement”) is a legally binding electronic record under the Electronic Transactions Act, 2008 (Act 772) of Ghana. By accessing or using TUWA, including the website www.tuwa.com.gh and the TUWA mobile app (“the Platform”), you agree to be bound by these Terms and all policies incorporated by reference.
The Platform is operated by TUWA Tech Ltd, a company registered in Ghana.
1. ACCEPTANCE OF TERMS
By accessing, browsing, creating an account, or transacting on TUWA, you (“User”, “You”) agree to comply with these Terms. If you do not agree, do not use the Platform.
TUWA reserves the right to update or modify these Terms at any time without prior notice. Continued use of the Platform after updates means you accept the revised Terms.
2. ELIGIBILITY
- You must be 18 years or older to register and transact on TUWA.
- If you are under 18, a parent or legal guardian must register and transact on your behalf.
- TUWA may suspend or terminate accounts where age information is found to be inaccurate.
3. ACCOUNT REGISTRATION & RESPONSIBILITIES
To access certain features, you must register an account. You agree to:
- Provide accurate, current, and complete information.
- Keep your login credentials confidential.
- Be responsible for all activities under your account.
If TUWA suspects fraudulent, inaccurate, or incomplete information, we may suspend or terminate your account.
4. COMMUNICATIONS
You consent to receive electronic communications from TUWA, including emails, SMS, in-app notifications, and other digital messages regarding orders, promotions, updates, and customer support.
5. FEES & CHARGES
- Registration on TUWA is free.
- TUWA may introduce new services or revise existing fees.
- Any changes will take effect immediately upon being posted on the Platform.
- All transactions are quoted in Ghana Cedis (GHS).
6. ACCEPTABLE USE POLICY
You agree NOT to use TUWA to:
✓ Upload, distribute, or share harmful, unlawful, defamatory, obscene, or abusive content.
✓ Infringe on intellectual property rights.
✓ Upload viruses, malware, worms, or harmful scripts.
✓ Attempt to gain unauthorised access to TUWA systems.
✓ Engage in fraudulent activities, including selling counterfeit or stolen items.
✓ Harass or harm other users, merchants, customers, or staff.
✓ Advertise or solicit users outside TUWA without permission.
✓ Manipulate transactions, reviews, ratings, or platform data.
TUWA reserves the right to remove or restrict any content or user violating these terms.
7. CONTENT OWNERSHIP & LICENSE
- All platform content (text, images, logos, code, graphics) is owned or licensed by TUWA and protected by Ghanaian copyright and intellectual property laws.
- Users may not copy, reproduce, modify, distribute, or commercially use TUWA’s content without written permission.
- By submitting posts, reviews, images, or materials on TUWA, you grant TUWA a worldwide, royalty-free, perpetual license to use, reproduce, and display such content for operational and promotional purposes.
8. THIRD-PARTY LINKS & MERCHANTS
TUWA hosts products from various sellers. TUWA is not responsible for:
- Content on third-party links
- Product listings by independent merchants
- Services, accuracy, or actions of third-party vendors
However, TUWA enforces strict marketplace rules and may sanction defaulting sellers.
9. PRIVACY & DATA PROTECTION
TUWA complies with Ghana’s Data Protection Act, 2012 (Act 843).
Your personal information is handled in accordance with our Privacy Policy.
By using TUWA, you consent to the collection, use, and processing of your data as outlined in the Privacy Policy.
10. ORDERING, PAYMENT & DELIVERY
Payment Methods:
TUWA accepts:
- Mobile Money (MTN, Vodafone, AirtelTigo)
- Bank Cards
- Bank Transfers
- Pay-on-Delivery (where applicable)
TUWA is not responsible for:
- Payment failures due to network issues
- Delays from your payment provider
- Unauthorized use of your payment instrument due to your negligence
Delivery:
Delivery timelines vary by location and seller.
By placing an order, you confirm that delivery information provided is accurate.
11. RETURNS, REFUNDS & CANCELLATIONS
Returns and refunds follow TUWA’s Return & Refund Policy, which supports Ghana’s Consumer Protection standards.
You may return eligible items within the specified return window if:
- The item is defective
- The wrong product was delivered
- The item does not match the description
Refunds are issued via the original payment method or TUWA Wallet.
12. LIMITATION OF LIABILITY
TUWA provides the platform “as is” and “as available.”
TUWA does not guarantee that:
- The site will be uninterrupted
- Information will be accurate, complete, or error-free
- Servers will be free from viruses
TUWA is not liable for:
- Losses resulting from unauthorised account access
- User or merchant violations
- Third-party failures (logistics, payments, networks)
- Business losses, data losses, or indirect damages
Your sole remedy for dissatisfaction is to discontinue use of the Platform.
13. SUSPENSION & TERMINATION
TUWA may suspend or terminate access if you:
- Violate these Terms
- Are involved in fraud or suspicious activity
- Provide false information
- Misuse the platform
All rights of TUWA survive termination.
14. GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by the laws of the Republic of Ghana.
Any disputes shall be resolved through:
- TUWA internal dispute resolution
- Mediation or arbitration under the laws of Ghana (if unresolved)
